Terms of use

Effective 17 October 2026

These terms are an agreement between you and Bluespark (John Ballinger), New Zealand, the operator of Whirr. By creating an account you agree to them. If you don't agree, don't use Whirr.

1. Your account

  • You must be 16 or older and give accurate details.
  • Keep your device and sign-in secure. You are responsible for what happens on your account.
  • You can delete your account at any time in the app.

2. Zero tolerance for objectionable content and abusive users

Whirr has zero tolerance for objectionable content and abusive behaviour. You must not post or send anything that is hateful, harassing, threatening, sexually explicit, violent, discriminatory, defamatory, spam, or otherwise objectionable, and you must not bully, stalk, impersonate or intimidate anyone.

  • We automatically filter objectionable language in names, comments, ride chat and club content.
  • You can report any ride, comment, message, rider or club, and block any rider. Blocking hides their content from you and stops them contacting you.
  • We review reports and act on them within 24 hours: we remove the content and remove or ban the user who posted it.
  • Club admins can remove content and members from their clubs.

3. E-bikes and motorised rides are banned

Whirr is for rides under your own power. E-bike rides are not allowed and are rejected when imported. Rides or segment efforts that look motorised are flagged automatically and excluded from leaderboards, challenges and jerseys until a club admin reviews them. Repeatedly uploading e-bike or motorised activities may lead to removal from clubs or from Whirr.

4. Ride safely — at your own risk

  • Cycling has risks. You ride at your own risk and are responsible for your own safety, fitness and equipment.
  • Obey the road rules and the law at all times. Be courteous to other road users.
  • Segments and leaderboards are not races. Never ride dangerously, run red lights or ride beyond your ability to chase a time. Whirr does not create leaderboards on descents.
  • Club rides are organised by clubs and ride leaders, not by us. Check details with the organiser.
  • Information in Whirr (routes, times, meeting points) may be wrong. Use your judgement.

5. Your content

You own your rides, photos and posts. You give us permission to store and show them to the people you choose, only to run Whirr. We never use your content to train AI models and never sell it. You can export your original ride files at any time.

6. Fair use

Don't upload rides that aren't yours, fake data, or manipulate leaderboards. Don't scrape, reverse-engineer, overload or attack the service.

7. Ending things

You can stop using Whirr and delete your account whenever you like. We may suspend or remove accounts that break these terms, especially section 2 or 3.

8. The service

Whirr is free and provided "as is". We work hard to keep it running but can't promise it will always be available or error-free. To the extent the law allows, we aren't liable for indirect losses or for injury, loss or damage arising from rides you take. Nothing in these terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where they apply.

9. Changes

We may update these terms. If a change matters, we'll tell you in the app before it takes effect.

10. Law

These terms are governed by the laws of New Zealand, and New Zealand courts have jurisdiction.
